The Hirer Terms include clause 9A on de-identified data: read clause 9A.
Clause 11.1A — Commitment pricing (Hirer Terms of Business)
Clause 11.1A forms part of the Hirer Terms of Business, which you sign before the first assignment. Its full text:
11.1A Commitment pricing. Where the Charges for an Assignment are set at a reduced commitment rate (the Standard, Regular or Contract rate shown in the quote) because of the booked length and weekly hours, and the Hirer ends the Assignment before the end of the booked period, the Charges for all hours already worked on that Assignment shall be recalculated at the Short Notice rate of £20.50 per hour (plus any night premium and VAT), and the difference shall be added to the next invoice. Hours not worked are not charged. This clause does not apply where the Assignment ends because (a) the Employment Business fails to supply a Temporary Worker for booked shifts, or (b) the Hirer has reasonably objected to a Temporary Worker's performance or conduct and the Employment Business has not supplied a suitable replacement within 2 working days. The commitment rate and this clause are shown in the quote before the booking is made.
In plain English:
- Discounted rates (Standard, Regular and Contract) depend on the length of booking you commit to.
- If you end a discounted booking before the booked period, the hours already worked are re-charged at the short-notice rate of £20.50/hr (plus any night premium) + VAT. The difference is added to your next invoice.
- Hours not worked are not charged.
- This does not apply if we fail to supply staff, or if you reasonably object to a worker's performance or conduct and we cannot supply a suitable replacement within 2 working days.
This summary does not replace clause 11.1A itself. The full Hirer Terms of Business are sent with your confirmation and available in your client portal.
